集体土地使用权转让
集体土地使用权转让是指原有土地所有者将其集体土地使用权转让给其他使用者，在一定时期内，将使用权以某种形式让与给出，其他使用者接受转让的权利，也就是“集体土地使用权转让”。
集体土地使用权转让是中国制定的一种土地改革手段，于1993年在涉及经济发展的发展领域出台。该政策起到了重要作用，使中国不需要发展领域国有及一般集体土地，加快了社会主义市场经济的实施，积极推动了财政改革，提高了国有及一般集体土地收益，促进了工资级别的提高，解决了拆迁及国有及一般集体土地利用缺乏适当管理等问题。
集体土地使用权转让的有效性也得到了认可。一方面，它使经营者得以独立全权经营，让经济发展、投资及管理科技等方面有更大的发挥空间，而且运用特殊的手段可以定制经济类型；另一方面，它能够有效解决土地供应紧张的问题，而且可以换取土地资源的利用，建立有效的经济激励与回报机制，促进以农业为主的地方经济发展，对贫困县促进经济发展，使村村都有获得成功的机会。
在当前，我国政府正在推行集体土地使用权转让政策，逐步实施地方配套政策，以促进经济发展，深化改革，保障国家粮食安全，减轻土地供应紧张的压力。相应的，政府要注重留住转让土地的管理人员，开展有效的土地定位，积极加强土地腐败的整治，提高集体土地的生产、经营能力，加强转让土地的系统管理，提供合理的经营筹码、发展平台，创新和开发土地资源，实现和谐发展，真正形成有利于进一步发展的土地经济制度。
In recent years, China has been promoting the transfer of collective land use rights – “collective transferring of land use rights”, which was first established in 1993 in the fields of economic development. This policy has played an important role in accelerating the implementation of socialist market economy, promoting fiscal reform and improving the income of state-owned and collective land. It has also solved the problems of land requisition, lack of proper management of state-owned and collective land and low wages.
The effectiveness of the collective transfer of land use rights is also recognized. On the one hand, it enables operators to independently manage the land without external control, which creates more space for economic development, investment and management technology. On the other hand, it can effectively solve the problem of land supply shortage and exchange for the use of land resources, establish an effective economic incentive and return mechanism, promote the economic development of agricultural-based localities, and give the poor counties an opportunity to succeed.
At present, the Chinese government is promoting the policy of collective transfer of land use rights, gradually implementing local supporting policies to promote economic development, deepening reform, ensuring national food security, and reducing the pressure of tight land supply. Accordingly, the government should pay attention to retaining the managers of the transferred land, carry out effective land location, actively strengthen the corrective action on land corruption, and improve the production, operation capacity of the collective land, strengthen the system management of the transferred land, provide reasonable operating capital, development platform, innovate and develop land resources, and achieve harmonious development, so as to truly form a land economic system conducive to further development.
集体土地使用权
集体土地使用权是指乡村土地所有权归集体所有，集体以共有的方式对居民实行土地管理和发放使用权的行政经济制度。集体土地使用权是大部分中国乡村土地归集体所有，而集体不能直接取得土地使用权，土地使用权只能由集体派发给地主个人或小家庭使用，土地使用权由地主拥有及经营，且由集体实行集体管理的制度。
集体土地使用权的重要性在于：
一、加强社会政治稳定。集体土地使用权主要效力在于维护和谐的乡村社会环境，保护农民的整体利益。集体指定的标准土地使用权的有声明的优先有效性使得各地主统一行为，守法安置规则，行使这种责任，不会出现不规范的农村地主，有利于社会政治稳定。
二、实现农民收入有效增长。集体土地使用权制度也可以有效保障农民土地利益。农民获得未经剥削的土地资源可以进行合理利用，能有效提高农民收入，使地主获得均衡更高的收入，也可以减少客观上的收支不平衡，实现富有效果的增长。
三、促进农村社会发展。集体土地使用权的实施，既可以平缓和抑制客观上的土特产和土地资源现象，也使农业生产发展更加规范有序，更有利于社会经济发展，使农民更有财富可供充实生活，也有利于农村保持社会稳定，实现农民收入公平均衡增长，推动农村社会从落后走向现代化的社会道路。
总之，集体土地使用权的重要性不可忽视，为了更好地保障我国农村的农民合法权益，维护和谐的乡村社会环境，保护农民的整体利益，促进农业的稳定和持续发展，必须加强对集体土地使用权的保护。同时，只有遵守和执行集体土地使用权规范，当地政府才能有效管理和控制土地现象，消除各种权利冲突，实现农民土地安全有效发放，实现持续稳定的农业发展。
