《中华人民共和国城市规划法》《中华人民共和国城市规划法》《中华人民共和国城市规划法》1989年12月26日第七届全国人民代表大会常务委员会第十一次会议通过。1990年4月1日起施行。城市规划法共有六章四十六条。第一章，总则。阐明立法目的、适用范围、规划工作总的方针和原则，以及城市规划的主管部门。具体规定了:①城市规划法适用的地域范围为全国城市规划区。城市是指国家按行政建制设立的直辖市、市、镇;城市规划区是指城市市区、近郊区以及城市行政区域内因城市建设和发展需要实行规划控制的区域，其具体范围由城市人民政府在城市总体规划中确定。②国家实行严格控制大城市规模、合理发展中等城市和小城市的方针，促进生产力和人口的合理布局二大城市是指市区和近郊区非农业人口50万以上的城市;中等城市是指市区和近郊区非农业人口20万以上、不满50万的城市;小城市是指市区和近郊区非农业人口不满20万的城市。③城市总体规划应当和国土规划、区域规划、江河流域规划、土地利用总体规划相协调。第二章，城市规划的制定。规定了城市规划的主要内容、应遵守的原则、编制和审批的程序。并具体规定:①国务院城市规划行政主管部门和省、自治区、直辖市人民政府应当分别组织编制全国和省、自治区、直辖市的城镇体系规划，用以指导城市规划的编制。②编制城市规划一般分总体规划和详细规划两个阶段进行。大城市、中等城市为了进一步控制和确定不同地段的土地用途、范围和容量，协调各项基础设施和公共设施的建设，在总体规划基础上，可以编制分区规划。③城市规划实行分级审批，直辖市、省会城市、城市人口在100万以上的城市及国务院指定的其他城市(如苏州)的总体规划，由国务院审批;其他城市及建制镇的总体规划，经同级人民代表大会或其常务委员会审查同意，报上一级人民政府审批。城市详细规划和分区规划，均由各级城市人民政府审批第三章，城市新区开发和旧区改建。对城市新区开发和旧区改建应遵循的原则和须注意的问题作了规定。第四章，城市规划的实施。规定了城市规划经批准后的公布、实施、检查执行情况等事项。明确规定了实施城市规划的“一书”、“两证”制度:①城市规划区内的建设工程的选址和布局必须符合城市规划。设计任务书报请批准时，必须附有城市规划行政主管部门的选址意见书。②在城市规划区内进行建设申请用地的，必须按有关规定申请得到由城市规划行政主管部门核发的建设用地规划许可证后，方可向土地管理部门申请用地③在城市规划区内新建、扩建和改建各项工程设施的，必须按有关规定申请得到由城市规划行政主管部门核发的建设工程规划许可证后，方可向有关部门申请办理开工手续。第五章，法律责任。规定了对违反本法不同条款的当事人，视其违法行为事实与情节轻重，分别予以纠正、限期改正、处罚、处分，直至追究刑事责任。第六章，附则。规定了有关本法实施细则、实施办法的制定等事项。
